Rental Deposit (Borg) in the Netherlands: How Much Can a Landlord Ask?

CheckMyRent Team

Expats are often asked for large deposits, sometimes three months of rent or more. Since the Good Landlordship Act (Wet goed verhuurderschap) took effect on 1 July 2023, that is no longer allowed.

The maximum deposit

A landlord may ask a deposit (borg) of at most two months of base rent (kale huur). Service costs do not count towards that amount. If your contract started after 1 July 2023 and your deposit is higher, the excess is not allowed.

Getting your deposit back

  • The landlord must return the deposit within 14 days after the tenancy ends.
  • If the landlord deducts costs, for example for damage, they have 30 days and must explain the deduction.

Tips

  • Make photos and a written inspection report (opleveringsrapport) when you move in and when you move out.
  • Pay the deposit by bank transfer, never in cash, so you have proof.
  • Keep all communication about the deposit in writing.

Checking your deposit is a good moment to check your rent too. Our free rent check shows if your base rent is above the legal maximum.
